Total noob question.

Yeh this is a real noob question, ive been at war for this empire for ages and I want to make peace. Firstly, is "non intercourse" the peace equivient and if so is their some special way of doing it because im "brotherly" with them but they wont accept any treaty what so ever. Am I somehow doing something wrong or am I just unlucky?

Hello, and welcome!

Non-intercourse is not an equivalent of peace: it is an equivalent of no treaty, and should only be used for role-playing purposes. Non-aggression is the lowest treaty giving a peace, and all alliances/partnership will also be peace treaties.

I do not know about your second question, as it has been a very long while since I last played a game with the AI.

The AI can be really weird about Diplomacy. Sometimes they won't accept any offer, even though they love you.

One thing that has sometimes worked for me is to propose a trade with them, and include the treaty in the list of things you want.

The AI files have an entry about not accepting a treaty until after XX number of turns. It may have been limited by this.

Also, the ai may just want your stuff.

I remember someone saying to me along time ago that they wont accept a treaty until so many turns after your last combat with them. So you need to figure a way to keep your ships away from one another.

If the AI declares war upon you the chances of making peace with them is virtually impossible. It has been a long standing recommendation to new players in the event that they wish to make peace with a waring AI race to employ the Gun Boat method of peace.

In other words, you kick his arse and demand his surrender until it is given. Good luck and enjoy.

You have to set "Turns Since Last War Before Friendly Treaty" to 0 in the AI politics file. Then they'll make peace.
