We need an option to disobey the treaty and shoot them anyway. Of course, the other empire will probably get very angry and declare war.

I disagree. You just have to break the treaty and then you can do what you want. Eveything else leads to the same diplomatic inconsistency we still have in many other aspects: The empire A demands that you attack empire B and you accept the demand but do nothing. Still empire A is very happy that your "honour your obligations"!

I found it out the hard way:
If you ever agree to a treaty with "no planet bombardment" allowed for your empire, don't attack enemy colonies!
My ship moved toward the colony but refused to fire and got slaughtered by the weapon platforms from the planet.

And it is so easy to miss this treaty element if you don't control very carefully the proposed treaty.

You can however land troops on the planet, if your troop transporter survives the fire of the weapon platforms.
